Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the Superstat platform available at https://superstat.com.au ("Platform") and the Superstat mobile application available on iOS and Android ("App"), both operated by Superstat Pty Ltd ("Superstat", "we", "us", "our").
By accessing or using the Platform or App, you agree to these Terms. If you do not agree, do not use the Platform or App.
1. Who can use the Platform and App
The Platform is intended for use by adults aged 18 or over, including parents, coaches, and authorised representatives of clubs, teams, schools, or organisations.
The App is intended for use by players, parents, coaches, and other individuals invited by a club or coach. Players under 18 may access the App where their club or organisation has obtained appropriate parental or guardian consent prior to issuing an invitation.
By using the Platform or App, you confirm that:
you are at least 18 years old, or you are a player under 18 accessing the App under an invitation issued by your club or organisation with parental or guardian consent
you have authority to act on behalf of your team, club, school, or organisation where applicable
your use of the Platform and App complies with all applicable laws and any relevant organisational policies
2. Description of services
Superstat provides:
a web-based platform that allows clubs, coaches, schools, and organisations to upload sports footage and receive AI-generated outputs, including player statistics, performance reports, match summaries, and highlight clips
a mobile application (iOS and Android) that allows players, parents, and coaches to view their own stats, view highlight clips, and create a player profile
Footage is processed overnight. Outputs are typically available the following day. The Platform and App are designed for private team and organisational use and are not real-time services.
3. Free trial
New users may access the Platform on a 7-day free trial basis. No payment is required during the trial period.
At the end of the trial period:
access to Platform features will cease unless a subscription is activated
data and content uploaded during the trial will be retained until you request deletion
you may request deletion of your trial data at any time by emailing kai@superstat.com.au
The free trial applies to the Platform only. App access is available to players invited by an active club or coach account.
Superstat reserves the right to modify or discontinue the free trial offer at any time.
4. Accounts
You are responsible for:
maintaining the security and confidentiality of your account credentials
ensuring all information you provide is accurate and up to date
controlling who you invite to access your content
all activity that occurs under your account
If you become aware of any unauthorised access to your account, notify us immediately at kai@superstat.com.au.
5. Player App access and invitations
Access to the App is by invitation only. Invitations are issued by a club, coach, or authorised organisation administrator.
By issuing an invitation to a player, the club or organisation confirms that:
the player has been made aware of how their data will be used
where the player is under 18, appropriate parental or guardian consent has been obtained prior to issuing the invitation
Superstat relies on the club or organisation to manage this consent process. Superstat does not independently verify the age of App users or the consent status of individual players.
Players using the App may:
view their own statistics and performance data
view their own highlight clips
create and manage a personal player profile
Highlight clips are view-only within the App. Players cannot share clips externally via the App.
6. User content and ownership
You retain full ownership of all video footage, data, and content you upload to the Platform ("User Content").
By uploading User Content, you grant Superstat a limited, non-exclusive, royalty-free licence to:
store and host the content on secure infrastructure
process the content to generate statistics, insights, and outputs
provide access to authorised users you invite
make outputs available to players via the App where access has been granted
improve and develop the Platform and App, including AI systems, in accordance with our Privacy Policy
Superstat will not:
publicly display your User Content
distribute your User Content outside of authorised users
use your User Content for advertising or marketing purposes
7. Ownership of AI outputs
Superstat retains ownership of the AI-generated outputs, reports, statistics, and insights produced by the Platform.
By subscribing, you are granted a non-exclusive licence to access and use those outputs for your internal sporting, coaching, and organisational purposes. Players granted App access may view outputs relating to their own performance.
You may not resell, sublicense, or commercially exploit AI-generated outputs without Superstat's prior written consent.
8. Privacy and data handling
Your use of the Platform and App is subject to our Privacy Policy: https://superstat.com.au/privacy
By using the Platform or App, you acknowledge that:
video footage and player data will be processed to generate outputs
data may be used to improve the Platform in accordance with the Privacy Policy
content remains private and is only accessible to authorised users
players can only access data relating to their own performance via the App
9. Data processing - schools and organisations
Where Superstat processes personal information on behalf of a school or organisation, Superstat acts as a data processor and the school or organisation acts as the data controller for that personal information.
Schools and organisations using the Platform:
are responsible for ensuring all personal information uploaded complies with applicable privacy laws, including the Privacy Act 1988 (Cth)
must ensure appropriate consent has been obtained from students, parents, or guardians before uploading footage involving individuals under 18
must ensure their use of the Platform and App is consistent with their own privacy policies and any applicable education sector guidelines
Superstat will process personal information only as directed by the school or organisation and as set out in our Privacy Policy.
Superstat does not use student data for advertising, public display, or external distribution.
Schools requiring a formal Data Processing Agreement should contact kai@superstat.com.au.
10. Consent and uploader responsibility
You are responsible for ensuring that:
you have obtained all necessary consents from individuals appearing in uploaded footage
for individuals under 18, appropriate parental or guardian consent has been obtained before uploading footage and before issuing App invitations
your use of the Platform and App complies with applicable laws and your organisation's policies
Where a concern about consent is raised, Superstat may remove content or suspend App access at its discretion without notice.
11. Content access and sharing
All content on the Platform is private by default.
Access is limited to:
the uploader
users explicitly invited by the uploader (e.g. team members or coaching staff via email invitation)
players granted App access by their club or coach, limited to their own performance data and highlights
Superstat does not make content publicly available.
Highlight clips are view-only within the App and cannot be shared externally via the App.
12. AI outputs and accuracy
The Platform and App use artificial intelligence to generate statistics, insights, and performance data.
You acknowledge that:
AI-generated outputs may not be 100% accurate and should be used as a guide only
outputs should not be relied upon as the sole basis for selection, assessment, or any other consequential decision
Superstat is not responsible for decisions made based on AI-generated outputs
13. Availability and uptime
Superstat targets 99% platform and App availability, measured on a monthly basis, excluding scheduled maintenance and circumstances beyond our reasonable control.
Superstat does not guarantee uninterrupted access and is not liable for downtime caused by:
scheduled or emergency maintenance
third-party service failures, including cloud infrastructure or AI providers
App store availability or device compatibility issues
circumstances beyond our reasonable control
14. Subscriptions and payments
Subscriptions are billed on a recurring basis, either monthly or annually, depending on the plan selected. Payments are processed through Stripe.
App access for players is included as part of an active club or coach subscription and is not billed separately to players.
By subscribing, you agree that:
your subscription will automatically renew at the end of each billing period unless cancelled before the renewal date
you are responsible for managing and cancelling your subscription
Superstat may update pricing with reasonable notice prior to your next renewal
15. Refunds
All subscription fees are non-refundable except where:
a billing error has occurred on Superstat's part
the Platform has experienced a material technical failure that substantially prevented access for a sustained period
Refund requests must be submitted within 30 days of the relevant billing date or incident by emailing kai@superstat.com.au.
16. Acceptable use
You agree not to:
upload footage or content without obtaining appropriate consent from all individuals appearing in it
upload content that is unlawful, harmful, sexually explicit, abusive, or otherwise inappropriate
upload content involving minors without parental or guardian consent
invite players under 18 to the App without first obtaining parental or guardian consent
attempt to reverse-engineer, copy, or exploit Superstat's AI systems or outputs
misuse, interfere with, or attempt to disrupt the operation of the Platform or App
use the Platform or App for any commercial purpose not expressly authorised by these Terms
Superstat reserves the right to suspend or terminate access for any breach of this clause without notice.
17. Intellectual property
All intellectual property in the Platform and App, including software, design, trademarks, and underlying AI systems, is owned by or licensed to Superstat.
Nothing in these Terms transfers any intellectual property rights in the Platform or App to you.
18. Limitation of liability
To the maximum extent permitted by law:
Superstat is not liable for any indirect, incidental, special, or consequential loss or damage
Superstat's total liability to you for any claim arising from your use of the Platform or App is limited to the total subscription fees paid by you in the 12 months preceding the claim
Superstat is not responsible for the accuracy of AI-generated outputs or for decisions made in reliance on them
Superstat is not liable for any loss arising from a club or organisation's failure to obtain appropriate parental or guardian consent before issuing App invitations to players under 18
Nothing in these Terms excludes or limits any rights that cannot be excluded or limited under the Australian Consumer Law.
19. Warranties
The Platform and App are provided "as is" and "as available".
To the maximum extent permitted by law, Superstat makes no warranties, express or implied, regarding the Platform or App, including as to fitness for a particular purpose, accuracy of outputs, or uninterrupted availability.
20. Force majeure
Superstat is not liable for any failure or delay in performing its obligations where that failure or delay results from circumstances beyond its reasonable control, including natural disasters, power outages, internet disruptions, third-party service failures, or government action.
21. Dispute resolution
If a dispute arises in connection with these Terms, the parties agree to attempt resolution in good faith:
the party raising the dispute notifies the other in writing
both parties attempt to resolve the dispute within 14 days
if unresolved, the matter may be referred to mediation
if mediation fails, either party may pursue legal remedies
Nothing prevents Superstat from seeking urgent injunctive relief where appropriate.
22. Termination and deletion
You may stop using the Platform or App at any time by cancelling your subscription and requesting deletion of your data.
If content is deleted at your request:
the video and all associated derived data, including statistics and insights, will be permanently removed within 30 days
player App access linked to that content will also be revoked
Superstat may suspend or terminate your access, or a player's App access, if these Terms are breached.
23. Changes to the Platform and App
Superstat may update, modify, or improve the Platform and App from time to time, including via App store updates.
We will take reasonable steps to communicate material changes and avoid substantially reducing core functionality without reasonable notice.
24. Changes to these Terms
Superstat may update these Terms from time to time.
Updated Terms will be published on the Platform with a revised effective date.
Continued use of the Platform or App after updates constitutes acceptance of the revised Terms.
25. Governing law
These Terms are governed by the laws of Victoria, Australia.
Each party submits to the non-exclusive jurisdiction of the courts of Victoria.
